Any advice when a kitchen designer/installer has gone M.I.A??

Hi all,

You were really helpful when we needed advice for our house, hoping you can help my brother with his kitchen renovation. He hired a kitchen designer/builder (who advertises on these pages) to make kitchen and wardrobe cabinets but all he has been left with is an incomplete job, probably 30% finished. The job was supposed to be finished before Christmas and the builder is now not returning calls or messing him around with times etc. My brother paid the deposit and more funds even though work promised was not delivered. All other tradies were amazing but not sure how to proceed with this. Anyone else been through this?

It’s not unusual for trades to go missing until after Australia Day. Not good. But not unusual. Make contact and reasonably ask to be the first client when they return to work. Is the quality and price otherwise good? It’s a good indicator if it is. What’s the word of mouth from the other trades you mentioned?

Hi, yes he has tried to make contact repeatedly. The other tradies have tried to contact him as well, they have found him very frustrating as he has held them up too. Not sure about the quality as not much has been done. Price was on par with other quotes but he got the job because he promised work would be done before Christmas slow down period. I love a QUALITY paint job. Few people know the ins and outs of a quality paint job but, a seasoned painter for INTERIORS will have many techniques and processes to dial up the end result. I love my painter and I listen closely to his advice and he is so expert (40 years) and good that he makes it look effortless. BUT IT'S NOT. Will find and post favorite picture of painted trim here. I think the secret is style and proportion of trim and then the quality of the finishing. Did you know most paint curing really needs 2 to 3 weeks to set up as a really good tough finish? "In a hurry" is the curse we mostly experience for improving interiors. I wonder sometimes how different things would be if people took the right amount of time to do things in the time frame related to that finishing task!

Excuse my duh-ness but i'm having difficulty trying to follow whats going on here. Are these two photos an exact replica of your house and pool ? If not a hasty sketch with dimensions could help a lot. By kitchen wall do you mean the wall behind the bar ? And where is the pool wall ? Are you considering the covered area as being "inside" ? Sorry for all those questions lol Sometimes when you have a design problem you need to turn it inside out or on it's head. If you can't beat it maybe embrace it by making a feature of it : i.e. contrast by having the lightest colored pool surround and a great blue or tile inside and under the overhang, something that will echo the water color ? If you have a great covered area as in photo you'll most likely be spending a lot of time there and it could be soothing to be able to sometimes retire into a darker inside. In my book, 10M isn't small and also contrasting two floor colors doesn't necessarily make a space seem smaller and confined and may in fact even open it up. Could it be that you've thought yourself into a box here ? Sometimes one needs to give it all a good shake up and see how it resettles.

Thanks for the replies! My wife suggested we talk to a local real estate agent, so i think that is a good idea... just that Im not sure how helpful they are likely to be if we arent selling yet :) As for saving for our dream house, I dont disagree, however if doing this up nicely over the next ~5 years or so while we live here nets us some extra in the eventual sale, then that of course will help us as well. Interesting thing happened today actually. I got a knock on the door and one of the older neighbours asked if he could take some lemons from the tree. I of course said yes. Anyway he was telling me he had lived in the street for 40 years. I asked him if the house had always looked like this, and he said no that ~30 years ago the old old owner did a massive renovation and pulled off the timber and put up the bricks and gutted the inside of the house. Thanks for your comments everyone. We've taken your advice (Luke and NH) and changed the island to a rectangle (1200 x 3000). We lose one breakfast bar seat but gain storage and dining room space plus it shortens the distances from the island to the cooktops. It also removes the need for a corner carousel. We're much happier with this result. Dairy_maid, we've done what you suggested and walked through some common tasks. Overall it works reasonably well although we may keep some coffee spoons and butter knives in the scullery drawers for morning toast and coffee. We've also invested in a "silent" rangehood which has the motor on the outside of the house behind the fridge and we've upgraded the scullery sink to one that is 600 x 400 (internal size). Fabrication starts tomorrow. Woohoo. Once again, thanks so much for taking the time to respond. The design has been significantly improved with your input.

Update:

This is now going before the Tribunal as after months of broken promises, shoddy workmanship and numerous attempts to just get the job finished, work is still not complete. Apparently this builder is not licensed and no contract was provided before work started. He also has most of the full fee not just the deposit.

So, can anyone please advise how the Tribunal may judge this case given there was no contract and no builders licence? There is email and text message evidence of the agreement, cancelled meetings, negotiations etc.

Should my brother retain legal representation? Who would be responsible for legal costs?

Any guidance on this matter would be very appreciated.
